‘Change of Use’ under the Building Act refers to a building being used for a different purpose than it is currently consented for. With its new use, there will be safety considerations for the users of the building.
An example of a ‘Change of Use’ is when a building is constructed as a commercial building, but the owner now wishes for people to sleep in it. The Building Code requires that these people have access to hygiene facilities, natural light, ventilation, fire protection, cooking facilities and the like when using the building. These requirements are checked as being present under a ‘Change of Use’ application.
The application is in the form of a letter from the building owner to the Territorial Authority (in this case Hamilton City Council) informing them of the ‘Change of Use’ and addressing how the building in its new use will comply with the Building Code. Any changes that need to be made to the building elements can also be addressed through the building consent process.
